Obligatory to make hijrah

One of our
brothers/sisters has asked this question:
Is it obligatory for muslims to make hidrah? if so must it be to a muslim land? What makes a land a muslim land? And after making hidrah can a husband band his wife from going to vist her family because he says it s not a muslim land where the family lives? The family is to poor to visit her.

Answer:
In the name of Allah, We praise
Him, seek His help and ask for His forgiveness. Whoever Allah guides none
can misguide, and whoever He allows to fall astray, none can guide them aright.
We bear witness that there is no one (no idol,
no person, no grave, no
prophet, no imam, no dai,
nobody!) worthy of worship but Allah Alone, and we bear witness that
Muhammad(saws) is His slave-servant and the seal of His Messengers.
Your question: Is it obligatory for muslims to make hidrah?
Hijrah or migration from a land
where the believers are prosecuted for their faith becomes obligatory in
certain conditions, and voluntary in
some conditions. If the state of the
place where the believers are staying is like the state of Makkah before
Hijrah, and there is an Islamic State
available which will welcome them,
then Hijrah becomes obligatory. But if there is no Islamic State
available, then the Hijrah is optional
like the early migration of the believers from Makkah to Habasha (present
Ethiopia).
Your question: if so must it be
to a muslim land?
If a believer is being
prosecuted and oppressed because of his faith in Allah, and there is an Islamic State available
which will welcome him, then he must
migrate to the muslim land. But if
there is no Islamic State available, he
may do Hijrah to a non-muslim land
where he believes he will not be prosecuted and oppressed because of his
faith, if he wishes to do so.
Your question: What makes a land
a muslim land?
A land will be considered an
Islamic State where the laws of the land are in accordance with Shariah or
Islamic Law.
Your question: And after making
hidrah can a husband band his wife from going to vist her family because he
says it s not a muslim land where the family lives?
Allah Subhanah has given some
rights of the woman that is due to her parents and her relatives, and the husband does not have a right to
refuse permission to his wife if she wants to visit her family, whether they live in a muslim land or a
non-muslim land. For a husband to
refuse his wife permission to visit her parents and relatives, just because they happen to reside in a
non-muslim land, is against the
principles of Islam. But if the
husband fears for the safety of his wife,
or if there is a reason to fear that the disbelievers in the non-muslim
country might harass or oppress his wife for whatever reason, he may make arrangements for her
safety, or accompany her is he wishes
to do so, or delay the travel…. But as
a general rule, a husband should not
forbid his wife her right to visit her parents or relatives.
Whatever written of Truth and
benefit is only due to Allah’s Assistance and Guidance, and whatever of error
is of me. Allah Alone Knows Best and He
is the Only Source of Strength.
