Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

As Salaam alaikum.

My question is that if a marriage is supposed to take place on a partcular day, and there is a death of a close member of the girls family, one day before but the burial is done on the day of the marriage, is it right to go aheah with the nikaah, and can the rukhsati be done on the same day.

Thanks and Best Regards

Answer:

Postpone marriage for death

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

There is nothing in the Shariah which declares it forbidden or prohibits one to conduct a marriage on the day or the days following the death of a close relative. It is entirely upto the two families if they wish to go ahead with the marriage as planned, or to postpone it to a later date.

If both parties agree to go ahead with the marriage as planned, there is absolutely no harm and no restriction if they choose to do so….and if both parties agree to postpone the marriage to a later date of their convenience, that too would be absolutely acceptable and permissible in Shariah.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
