As Salaam Aleikum wa Rahmatullahi wa Barakatuh.  (May Allah's Peace, Mercy and Blessings be upon all of you)

 

One of our brothers/sisters has asked this question:

 

THANKS FOR SENDING I WOULD LIKE TO REQUEST FOR ZAKAT WHETHER APPLICABLE TO INDIVIDUAL WHO HAS PROPERTY LIKE HOUSE(NOT OCCUPIED) AND NO MONEY IN BANK.CAN YOU PLEASE EXPLAIN IN DETAILS IN ACCORDANCE WITH QURAN AND HADITH,

Answer:

 

Zakah on house unoccupied

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Shariah Law allows that the house one lives in, or the car one drives, etc. are exempt from zakah.

 

But if one has an extra property or house which one may have bought as an investment or otherwise, then it would be amongst one’s excess wealth; and zakah would indeed be annually liable upon the market value of this property at the rate of 2.50%. 

 

If one has a property upon which annual zakah is due, and one does not have any savings or cash to pay those zakah dues, then one would either have to rent the property to derive an income so that he may fulfill his zakah dues, or sell a part of the property, or arrange from other lawful means to pay the annual zakah on his property.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.
