One
of our brothers/sisters has asked this question:
Dear Brother ,
Adab ,
What is said in light of Quran
& Hadith , regarding the agreement between employer and employee.
If employee has an agreement
with employer & employee doesnt ask for something during his service , and
employee will ask which was not given to him during the service period at the
end of service .
Does that demand stand or
becomes void ?
(There may be some
grammatical and spelling errors in the above statement. The forum does not
change anything from questions, comments and statements received from our

Answer:
Employee Employer contract
In the name of Allah, We praise Him, seek His help and ask
for His forgiveness. Whoever Allah guides none can misguide, and whoever
He allows to fall astray, none can guide them aright. We bear witness that
there is no one (no idol, no person, no
grave, no prophet, no imam, no dai,
nobody!) worthy of worship but Allah Alone, and we bear witness that
Muhammad(saws) is His slave-servant and the seal of His Messengers.
If the employer and the employee have agreed upon an agreement; and the employee fulfills his part of the agreement in full; then it would become incumbent upon the employer to fulfill his part of the agreement.
Al-Tirmidhi Hadith 2987 Narrated by Abdullah ibn Umar
Allah's Messenger (saws) said,
"Give the hireling his wages before his sweat dries."
If the employee has fulfilled his part of the agreement, and subsequently the employer refuses to fulfill his part; the employee is well within his rights to demand the employer to fulfill his part of the agreement, failing which the employee is well within his rights to move the Courts to get the employer to fulfill his part of the agreement.
Sahih Al-Bukhari Hadith 3.470 Narrated by Abu Huraira
The Prophet (saws) said,
"Allah said, 'I will be an opponent to three types of people on the Day of
Resurrection:
1. One who makes a covenant in My Name, but proves treacherous;
2. One who sells a free person and eats his price; and
3. One who employs a laborer and takes full work from him but
does not pay him for his labour.' "
Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me. Allah Alone Knows Best and He is the Only Source of Strength.
