Iddah of one two divorce
Mu' meneen Brothers and Sisters,
As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's
Peace, Mercy and Blessings be upon all of you)
One of our brothers/sisters has asked this question:
ASALAMUALAYKUM/BROTHER BURHAN,
I HAVE A QUESTION AND I HOPE THAT YOU CAN ANSWER IT A.S.A.P.
(1)IF A HUSBAND GIVES HIS WIFE ONE TALAAQ,THEN WITHEN
THE IDDAH MAKES RUJU OF THE TALAAQ ,THEN AGAIN GIVES HER ANOTHER TALAAQ,SO IS
THIS CONSIDERED ONE TALAAQ OR TWO?AND IF ITS TWO TALAAQ THEN DOES THE
IDDAH START ALL OVER AGAIN FROM THE SECOND TALAAQ OR DOES IT STILL COUNT
FROM THE FIRST TALAAQ?

Answer:
In the
name of Allah, We praise Him, seek His help and ask for His forgiveness.
Whoever Allah guides none can misguide, and whoever He allows to fall astray,
none can guide them aright. We bear witness that there is no one (no idol, no
person, no grave, no prophet, no imam,
no dai, nobody!) worthy of
worship but Allah Alone, and we bear witness that Muhammad(saws) is His
slave-servant and the seal of His Messengers.
Q-1:
IF A HUSBAND GIVES HIS WIFE ONE TALAAQ,THEN WITHEN THE IDDAH MAKES RUJU OF THE
TALAAQ ,THEN AGAIN GIVES HER ANOTHER TALAAQ,SO IS THIS CONSIDERED ONE TALAAQ OR
TWO?
Allah Says in the Holy Quran Chapter 2 Surah Baqarah verses 227-228:
227 But if their intention is firm for divorce Allah heareth and knoweth
all things.
228 Divorced women shall wait concerning themselves for three monthly
periods nor is it lawful for them to hide what Allah hath created in their
wombs, if they have faith in Allah and the Last Day. And their husbands have the better right to
take them back in that period if they wish for reconciliation. And women shall have rights similar to the
rights against them according to what is equitable; but men have a degree (of
advantage) over them and Allah is Exalted in Power, Wise.
Basically,
the husband can maximum pronounce three divorces in the period of one
marriage. If the husband pronounces one
divorce, and before the end of the ‘iddah’ or waiting period accepts the wife
back (ruju), the divorce and the ‘iddah’
will be deemed cancelled and the husband and wife will live together as
a married couple; but he will have used up one of his three divorce rights.
If after
taking the wife back, the husband announces a second divorce, a brand new
‘iddah’ period will start; and the husband will now have used up two of his
three divorce rights.
Q-2:
AND IF ITS TWO TALAAQ THEN DOES THE IDDAH START ALL OVER AGAIN FROM THE
SECOND TALAAQ OR DOES IT STILL COUNT FROM THE FIRST TALAAQ?
If the husband has taken his wife back (ruju) within the ‘iddah’ period, the
first divorce and the ‘iddah’ of that divorce will be cancelled and absolved
immediately. If the husband pronounces a
second divorce after the ‘ruju’, a brand new ‘iddah’ period must be calculated
from the date of the pronouncement of the second divorce.
Whatever
written of Truth and benefit is only due to Allah’s Assistance and Guidance,
