Divorce in front of witness
Mu' meneen Brothers and Sisters,
As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's
Peace, Mercy and Blessings be upon all of you)
One of our brothers/sisters has asked this question:
Hi,
I want to ask you that is there any way
in Islam to marry the same women without “HALALH”, since the man has not said
the “TALAQ” words by mouth but it has been given in writing and at front of two
“GAWAHAN”. I’ll be really obliged to know about this matter.
Thanks
Please do not publish my e-mail address.
Once again thank you,
Khuda Hafiz

Answer:
Divorce
in front of witness
In the
name of Allah, We praise Him, seek His help and ask for His forgiveness.
Whoever Allah guides none can misguide, and whoever He allows to fall astray,
none can guide them aright. We bear witness that there is no one (no idol, no
person, no grave, no prophet, no imam,
no dai,
nobody!) worthy of worship but Allah Alone, and we bear witness that
Muhammad(saws) is His slave-servant and the seal of His Messengers.
Beloved
brother in Islam, we are not too sure what you mean by the terms ‘HALALH’. We request you to kindly restate your
question, to enable us to give you a proper answer in light of the Quran and Sunnah.
Divorce
or ‘Talaq’, whether given verbally or in a written
form, will be considered and counted as a divorce in Islam, regardless of
whether there were any witnesses to this divorce or not; because having
witnesses is not a condition when giving divorce.
Whatever
written of Truth and benefit is only due to Allah’s Assistance and Guidance,
and whatever of error is of me. Allah
Alone Knows Best and He is the Only Source of Strength.
Your Brother in Islam,
Burhan
