75) Chapter: Selling A Tree But Not Its Produce
It was narrated from Ibn 'Umar that the Prophet said:
"Any man who pollinates a date-palm tree then sells it, the fruits of the tree are for the one who pollinated it, unless the purchaser stipulated otherwise."
75) باب النَّخْلِ يُبَاعُ أَصْلُهَا وَيَسْتَثْنِي الْمُشْتَرِي ثَمَرَهَا
أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا اللَّيْثُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ . " أَيُّمَا امْرِئٍ أَبَّرَ نَخْلاً ثُمَّ بَاعَ أَصْلَهَا فَلِلَّذِي أَبَّرَ ثَمَرُ النَّخْلِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ "
