I am facing a question that what should a muslim do whenever he/she is facing a case like HONOUR KILLING.

One of our brothers/sisters has asked this question:

I am facing a question that what should a muslim do whenever he/she is facing a case like HONOUR KILLING under the principles of Islam? being a muslim it,s our responsibilty to decide such cases by consulting THE HOLY BOKK QURAN.

wht are the principles and teachings given by Islam to settle an issue of HONOUR KILLING?

Answer:

 

The issue of honor killings

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

If one is found guilty of transgressing one of the prescribed boundaries of Allah Subhanah where Allah and His Messenger (saws) have prescribed a specific punishment (theft, burglary, fornication, adultery, murder, etc.)….no individual has a right to extract the prescribed punishment on his own, but rather the case should be taken to a Shariah Court, and if the Shariah Court Judge is satisfied with the evidence presented, he will prescribe and extract the due punishment in accordance with Shariah Law.

 

If an individual or a ‘mob’ of individuals take the law in their own hands and extract punishment from the guilty without due process of law, they are the ones who will be considered oppressors and will be duely punished by the law.

 

The concept of ‘honor killings’ where an individual or a family takes the law into their own hands and ‘murders’ one whom they think is guilty of a sin is an absolute abomination and a manifest transgression of the Laws of Allah Subhanah! 

 

Sahih Muslim Hadith 3569     Narrated by Abu Hurayrah

Sa'd ibn Ubadah al-Ansari (r.a.) said: ‘O Messenger of Allah (saws), tell me if a man finds his wife with another person, should he kill him?’ Allah's Messenger (saws) said: ‘No!’ In another narration the Messenger of Allah (saws) is reported to have said: ‘If he (the husband) kills the man, we will ‘kill’ him (in retribution for murder according to Shariah Law).’

 

If Allah forbid, one were to take the law in their own hands and kill the person whom they think is guilty of a crime, they will be brought to justice for the heinous crime of ‘intentional’ murder in a Court of Shariah Law, who will then extract due punishment from them for their heinous and grave crime of ‘intentional’ murder!  

 

Allah Says in the Holy Quran Chapter 4 Surah Nisaa verse 93:

93      If a man kills a believer intentionally his recompense is Hell to abide therein (for ever): and the Wrath and the Curse of Allah are upon him and a dreadful penalty is prepared for him.

 

Allah Says in the Holy Quran Chapter 2 Surah Baqarah verses 178-179:

178    O ye who believe! The law of ‘Qisas’ (retribution) is prescribed to you in cases of murder; the free for the free, the slave for the slave, the woman for the woman.  But if any remission is made by the brother of the slain then grant any reasonable demand and compensate him with handsome gratitude; this is a concession and a Mercy from your Lord.  After this whoever exceeds the limits shall be in grave penalty.

179    In the law of ‘Qisas’ there is (saving of) life to you, O ye men of understanding; that ye may restrain yourselves.

 

If one trusts, obeys, and follows the guidance and commands of Allah and His Messenger (saws),   one can be assured of never ever being misled;   but if one believes, obeys and follows any other guidance, other than that of Allah and His Messenger (saws), one can be assured of being led astray.  

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.
