KYA islam fraud se mana nahi karta?

One of our brothers/sisters has asked this question:

Bad salam, main apse ek que. puchhna chahta hun.Que:

Mere walid sahab aur mere grand papa ne 40 sal pehle hamare padosi (neighbour) jo hotel chalate hai unko hamare makan(house ) ka half hissa rent par diya tha, Ab mere walid sahab aur mere grand pa is death. Ab hamara kirayadar monthly rent bhi nahi deta hai aur kehta hai ke tumhae bap - dada ne is jagah ko hame kiraye par di thi is liye ab tumhara koi hakk (right for properitor) nahi, kya in ka yeh kehna sahi hai? KYA islam fraud se mana nahi karta?

Answer:

 

Dishonest orphan inheritance

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Allah Says in the Holy Quran Chapter 2 Surah Baqarah verse 188:

188    And (O you who believe) do not eat up your property among yourselves for vanities nor use it as bait for the judges with intent that ye may eat up wrongfully and knowingly a little of (other) people's property.

 

Sahih Muslim Hadith 182      Narrated by Abu Hurayrah

The Messenger of Allah (saws) observed: ‘He who took up arms against us (believers) is not of us; and he who acted dishonestly towards us is not of us!’

 

Sahih Al-Bukhari Hadith 1.32 Narrated by Abu Huraira

The Prophet said, "The signs of a hypocrite are three:

1.       Whenever he speaks, he tells a lie.

2.       Whenever he promises, he always breaks it (his promise ).

3.       If you trust him, he proves to be dishonest. (If you keep something as a trust with him, he will not return it.)"

 

Dear and beloved brother, not only does Islam abhor, detest, and declare any and all kind of dishonesty and fraud absolutely and unconditionally unlawful and haraam….if one is so daring that he misappropriates or is dishonest with the inheritance proportions of the orphans, his accounting in the Presence of the All-Just Lord will be unimaginably severe!  

 

Allah Says in the Holy Quran Chatper 4 Surah Nisaa verse 2:

2        To orphans restore their property (when they reach their age), nor substitute (your) worthless things for (their) good ones; and devour not their substance (by mixing it up) with your own.  For this is indeed a Great Sin.

 

Allah Says in the Holy Quran Chatper 4 Surah Nisaa verses 9-10:

9        Let those (disposing of an estate) have the same fear in their minds as they would have for their own if they had left a helpless family behind: let them fear Allah, and speak words of appropriate (comfort).

10      Those who unjustly eat up the property of orphans eat up a fire into their own bodies: they will soon be enduring a Blazing Fire!

 

Allah Says in the Holy Quran Chapter 17 Surah Israa verse 34:

34      Come not nigh to the orphan's property except to improve it until he attains the age of full strength; and fulfil (every) engagement for (every) engagement will be enquired into (on the Day of Reckoning).

 

Allah Says in the Holy Quran Chapter 89 Surah Al-Fajr verses 17-26:

17      Nay nay! But ye honor not the orphans!

18      Nor do ye encourage one another to feed the poor!

19      And ye devour inheritance all with greed.

20      And ye love wealth with inordinate love!

21      Nay! When the earth is pounded to powder

22      And thy Lord cometh and His Angels, rank upon rank

23      And Hell that Day is brought (face to face); on that Day will man remember! But how will that remembrance profit him?

24      He will say: "Ah! would that I had sent forth (good) for (this) my (future) life."

25      For that Day His (Allah’s) Chastisement will be such as none (else) can inflict!

26      And His (Allah’s) bonds will be such as none (other) can bind!

 

Dear and beloved brother, if your father or grand-father had entrusted your neighbors with their property, and after their death he is refusing to hand it back to their legal heirs and claims it to be his own….you are well within your rights in the life of this world to exercise the full extent of the law, and seek to reclaim your rightful property. 

 

Allah forbid, even if your neighbors get away in the life of this world with consuming your rightful inheritance under any pretext, rest absolutely assured that they will not be able to get away with their injustice, dishonesty, blatant theft, and abuse in the Presence of The All-Knowing, All-Just Lord Most Majestic on that Inevitable and Tumultuous Day of Justice!  

 

Allah is our witness brother, if only those who devour the inheritance or property of other’s without right knew the Trial and the Tribunal that awaits them in the Presence of The Lord Most Majestic, they would never ever even dream of eating another’s wealth or property without right!

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.
