I have jewellery that my parents gave me on my wedding. It`s almost 250 lakhs of pakistani ruppees and it`ld be around 250 thousands of canadian dollars

Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh.  (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

Assalam-u-Allaekum
Hope you`ll fine by the grace of my almighty ALLAH. I have some questions to ask. My first question is that me and my husband don`t have enought money for zakat. After paying all the utuilities and bills we don`t have enough money to pay zakat. I have jewellery that my parents gave me on my wedding. It`s almost 250 lakhs of pakistani ruppees and it`ld be around 250 thousands of canadian dollars or more. Now please tell me wat should we do?

Mysecond question is that one of my friend can`t get pregnant, because she is not able to give birth to a baby. There is a treatment that called IVF. Wat happens in this treatment that is a woman don`t have eggs in her ovaries then she`ll have to get egg from any fertility clinic then doctors will put her husband`s sperm in that egg, and then that egg will fertilize and then they`ll put that egg in tht woman`s ovaries, and then that egg will become an embryo and will grow in that woman`s uterus. Now i have a question that my friend is worried about that where will she get that donation of egg from? She wants to get that egg from her family but she wants to know that if it`s right according to Islam or not.....Please brother reply me AS SOON AS YOU CAN....so that i can pay zakat accordingly and i can tell my frind wat`s right or wrong.

Thankyou

Answer:

Zakah and fertility

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person,  no grave, no prophet,  no imam,  no dai,  nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

My first question is that me and my husband don`t have enought money for zakat. After paying all the utuilities and bills we don`t have enough money to pay zakat. If the total nett worth of any believer is more than the prescribed ‘nisaab’ of 7.5 tolas of gold (app. 85 grams or app. Value US$1,000.00), then the person is liable to pay the obligatory zakat of 2.5% on their excess wealth which has been in their possession for a full calendar year.

Sunan of Abu-Dawood Hadith 1558  Narrated by Abdullah ibn Amr ibn al-'As

A woman came to the Messenger of Allah (saws) and she was accompanied by her daughter who wore two heavy gold bangles in her hands.  He (saws) said to her: ‘Do you pay zakat on them?’  She said: ‘No.’  He (saws) then said: ‘Are you pleased that Allah may put two bangles of fire on your hands?’ Thereupon she took them off and placed them before the Prophet (saws) saying: ‘They are for Allah and His Messenger (saws).’

Dear and beloved sister, if after paying the expenses you and your husband are left with no money to pay the zakah that is due on your excess wealth which includes the jewelry that you possess, you should liquidate or sell part of your excess wealth or jewelry if your have to, and fulfill the annual obligatory zakah dues to your Lord.

Your Question: Now i have a question that my friend is worried about that where will she get that donation of egg from? She wants to get that egg from her family but she wants to know that if it`s right according to Islam or not

The Holy Quran and Sunnah are obviously silent on the issues like IVF treatment, as these transplants were obviously made available only after the advancements of technology and modern medicine,  which were not available at the time the Quran was being revealed.  The scholars in Islam have debated on this issue in light of the principles of the Quran and Sunnah, and the majority of them are of the opinion that there is no harm if a married couple for some reason are unable to conceive and wish to take advantage of such treatments, provided the eggs of the wife are fertilized in a laboratory through the sperms of her own husband.

The scholars of all the schools of thought are absolutely unanimous in their opinion that it would be absolutely unlawful and impermissible in Islam for a married couple to use the eggs or sperms of anyone other their very own, as that would immediately effect the rights and have bearings on the relations of the new born, if conceived.  If the eggs itself, or the sperm used to fertilize the eggs artificially are from anyone else or any source other than the husband and wife in marriage, such forms of IVF treatment would not be lawful or permissible in Islam.  And Allah Alone Knows Best.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
