I would like to marry my brother ex wife

Mu' meneen Brothers and Sisters,

As Salaam Aleikum wa Rahmatullahi wa Barakatuh. (May Allah's Peace, Mercy and Blessings be upon all of you)

One of our brothers/sisters has asked this question:

my sister in law obtained a divorce from my brother over 8 years ago, she has been living on her own with her 2 children and has not re-married. I am now wanting to marry her. This will however cause alot of hostility between the family. Her daughters are 12 and 15 years old. Meanwhile i am separated myself and have 5 children. Please advise whether We should marry?

Answer:

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

You are within your rights to marry your brother's divorced wife if the woman agrees. There is no restriction in this union whatsoever. As a matter of fact there is ajr in giving support to a divorced woman with children as long as there is no sinful or unlawful acts committed.

The family hostility will be there but as time goes it will vanish. That should not stop you doing something that is right.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me. Allah Alone Knows Best and He is the Only Source of Strength. Allah Alone Knows Best and He is the Only Source of Strength.
