Shariah ruling on illegal immigrants

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Allah Says in the Holy Quran Chapter 4 Surah Nisaa verse 135:

135    O ye who believe! Stand out firmly for justice as witnesses to Allah even as against yourselves or your parents or your kin and whether it be (against) rich or poor: for Allah can best protect both.  Follow not the lusts (of your hearts) lest ye swerve and if ye distort (justice) or decline to do justice; verily Allah is well-acquainted with all that ye do.

Allah Says in the Holy Quran Chapter 76 Surah Dhahr verses 5-12:

5        As to the Righteous they shall drink of a Cup (of Wine) mixed with Kafur

6        A Fountain where the Devotees of Allah do drink, making it flow in unstinted abundance.

7        They fulfill their vows, and they fear a Day whose evil flies far and wide.

8        And they feed for the love of Allah, the indigent, the orphan, and the captive

9        (saying): "We feed you for the sake of Allah alone: No reward do we desire from you nor thanks.

10      We only fear a Day of distressful Wrath from the side of our Lord."

11      But Allah will deliver them from the evil of that Day and will shed over them a light of Beauty and a (Blissful) Joy.

12      And because they were patient and constant, He will reward them with a Garden and (garments of) silk.

If a believer enters into an agreement with someone, it only befits the character of a believer that he strive his utmost to fulfill his share of the agreement or promise.  If one has applied and taken a visa or permit for a pilgrimage from the concerned authorities, he has in effect made an agreement with them that he would leave their land after the completion of his pilgrimage stay.  If one intentionally breaks their side of the agreement and chooses to illegally overstay after the pilgrimage, one would have acted dishonestly and absolutely against the sprit which befits the character of a believer who sincerely fears Allah and the Last Day.  Even if that person gets away with his dishonesty in the life of this world, he will never get away with it in the Court of the All-Knowing, All-Just Lord on that Inevitable Day of Justice.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,

Burhan
