Answer:

Clothes sex and ghusl

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is none worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Your Question: my wife when she wants to release her tension of sex she comes on with her clothes on ands rubs her vagina on my side while i am lying down on one side, she gets discharge in this position and nothings comes out from her and she asks me whether gusal is farz for her now as she did not take off here clothes and neither did i go inside and nothing came out from her. pls inform.

Sahih Muslim Hadith 684      Narrated byAbu Musa

There cropped up a difference of opinion between a group of Muhajirs (Emigrants) and a group of Ansar (Helpers) (and the point of dispute was) that the Ansar said: ‘The ‘ghusl’ (full bath) becomes obligatory only when the semen spurts out or ejaculates.’  But the Muhajirs said: ‘When a man has sexual intercourse (with the woman), a ‘ghusl’ (full bath) becomes obligatory (no matter whether or not there is seminal emission or ejaculation).’  AbuMusa said: Well, I shall satisfy you on this (issue).  He (AbuMusa, the narrator) said: ‘I stood up, (went) to Aisha and sought her permission which was granted. I said to her: :O Mother of the Faithful, I want to ask you about a matter about which I feel shy.”  She said: “Don't feel shy of asking me about a thing which you can ask your mother who gave birth to you, for I too am your mother.”  Upon this I said: “What makes a ‘ghusl’ obligatory for a person?”  She replied: “You have come across one who is well informed! The Messenger of Allah (saws) said: “When the private parts (of the man and the woman) touch each other. a ‘ghusl’ becomes obligatory.”’

Two acts during the process of sexual intercourse makes ‘ghuls’ obligatory:

  1. The release of ‘semen’ or full sexual discharge of the man or the woman.
  2. Regardless of whether one enters the other or not, regardless of whether one has a full sexual discharge or not, if the private organ of the man has merely even touched the private organ of the woman….a ‘ghusl’ or full bath of purification would be obligatory upon both the man and the woman before they make themselves available for prayer.

If the private organs of the man and the woman have neither touched nor entered into each other, nor was there a full sexual discharge by either the man or the woman, then a ‘ghusl’ or full bath would not become obligatory before they make themselves available for prayer.

Your Statement: ……she gets discharge in this position and nothings comes out from her and she asks me whether gusal is farz for her

The very term ‘discharge’ in this context would mean that some sexual emission is released from one’s private parts.

Fiqh-us-Sunnah Fiqh 1.10

Wadi is a thick white secretion discharged (by some people) after urination. It is considered impure.  Aishah said, " Wadi comes out after urination. The person should wash the private parts and perform ablution.  It is not necessary to perform ghusl. This is related by Ibn al-Mundhir.  Ibn 'Abbas related that "mani” (ejaculation or full sexual discharge) requires ghusl.  As for “madhi” (prostatic fluid or initial sexual discharge) and ‘wadi’ they require a complete purification."  This is related by al-Athram.  Al-Baihaqi has it with the wording, "Concerning ‘madhi’ and ‘wadi’, he said, 'Wash your sexual organs and perform the same type of ablution as you perform for prayer."'

There are basically three types of sexual discharges that are released from one’s private organs:

  1. Wadi (a thick white secretion immediately after urination by some people)
  2. Madhi (a sort of slow release of lubricant just prior to a full sexual discharge)
  3. Mani (a full sexual discharge)

If only Wadi or Madhi is released, one does not require a ‘ghusl’ or full bath to purify oneself; one must wash their private parts and the part of the clothes or body where the ‘wadi’ or ‘madhi’ has touched, do the wudu, and make themselves available for prayer.

If Mani or a full sexual discharge is released, then it become obligatory to perform a ‘ghusl’ or full bath to purify oneself.

Your Question: My another question is after having sex if i wash my parts clean and wear the same clothes will they be paak and specially the west and the shirt as it does not even touch the lower part of the body.

Sahih Muslim Hadith 572      Narrated by Aisha

Abdullah ibn Shihab al-Khawlani reported: ‘I stayed in the house of Aisha and had a wet dream (and perceived its effect on my garment), so (in the morning) I dipped both (the clothes) in water. This (act of mine) was watched by a maid-servant of Aisha and she informed her. She (Aisha) sent me a message: ‘What prompted you to act like this with your clothes?’ He (the narrator) said: ‘I told that I saw in a dream what a sleeper sees.’ She said: ‘Did you find (any mark of the semen) on your clothes?’  I said: ‘No.’ She said: ‘Had you found anything you should have washed it. In case I found semen on the garment of the Messenger of Allah (saws) dried up, I scraped it off with my nails.’

Sahih Muslim Hadith 566      Narrated by Aisha

A person stayed in the house of Aisha and in the morning began to wash his garment. Aisha said: ‘In case you saw it (i.e. semen), it would have served the purpose (of purifying the garment) if you had simply washed that spot; and in case you did not see it, it would have been enough to sprinkle water around it, for when I saw (dried) semen on the garment of the Messenger of Allah (saws), I simply scraped it off and he (saws) offered prayer, while putting that garment on.’

Sahih Al-Bukhari Hadith 1.229         Narrated by Aisha

I used to wash the traces of Janaba (semen) from the clothes of the Prophet (saws) and he (saws) used to go for prayers while traces of water were still on it (water spots were still visible on the garment).

Firstly, simply ‘washing one’s private parts clean’ after sexual intercourse would not suffice for purification.  If one has had a sexual intercourse with one’s wife, it is absolutely obligatory that one purify themselves with a ‘ghusl’ or full bath before they make themselves available for prayer.

Secondly, if one is absolutely certain that the sexual emission has not touched the upper garments (vest, shirt, etc.), then those garments will be considered absolutely pure and there is no harm if one wishes to pray in them.

Thirdly, if one finds a wet semen mark or spot on one’s garment, it would suffice that one wash that part of the garment thoroughly before wearing them during their prayers.

Fourthly, if one finds that the semen has completely dried off on the garment one wore during or immediately after their sexual intercourse, it would suffice to simply scrape off the semen.

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.

Your brother and well wisher in Islam,
