I have the following property, and request you to kind tell me on what I have to pay the Zakah

As Salaam Aleikum wa Rahmatullahi wa Barakatuh.  (May Allah's Peace, Mercy and Blessings be upon all of you)

 

One of our brothers/sisters has asked this question:

Dear Sir, Assalamo Alaikum !!


May the peace and blessings of Allah be on you for the good work you are doing.

I have the following property, and request you to kind tell me on what I have to pay the Zakah, and how to calculate it, so that I may follow the same procedure every year without any doubts arising in my mind if I have paid the Zakah correctly.


Property In my name:

  1. Plot of Land valued at Pakistan Rs.3 million
  2. Car Valued at Pak Rs.250,000 (In my personal use)
  3. I have a salary of Pakistan Rs.90,000 per month. (After payment of rent of house, education and other household expenses, I save Pak Rs.200,000 per year).


Property In wife’s name:

  1. Land plot valued at current price Pak Rs.3 million
  2. Land plot valued at current price Pak Rs.2 million
  3. Car valued at Pak Rs.350,000. (In wife’s use)
  4. Gold Jewellery belonging to and in personal use of wife, worth Pak Rs.250,000.

 

Please note that as yet we do not have our own house, and intend to construct one at one of the plots that we own. Also my wife does not have an income of her own, and the Zakat on property in her name will also be paid by me. Kindly give your valuable opinion in light of Quran and Hadeeth.

Answer:

 

Zakah calculations

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person,  no grave, no prophet,  no imam,  no dai,  nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

 

Beloved Brother in Islam, Allah has commanded the believers who have been blessed with more than their needs to annually share 2.5% of their surplus nett worth with their less fortunate brothers and sisters in faith, provided their surplus wealth has been in their possession for a period of one calendar year.

 

Property In my name:

Q-1: Plot of Land valued at Pakistan Rs.3 million

The plot of land is zakatable at 2.5% of its fair market value, provided it has been in your possession for a period of at least one calendar year.

 

Q-2:  Car Valued at Pak Rs.250,000 (In my personal use)

Any property or asset which is used to live one’s life is not liable for zakah, including one’s own house, one’s car, one’s furniture and fixtures, etc.  Thus, there is no zakah on the car, regardless of its value.


Q-3: I have a salary of Pakistan Rs.90,000 per month. (After payment of rent of house, education and other household expenses, I save Pak Rs.200,000 per year).

Zakah is not paid on one’s annual income or salary; but rather zakah is a poor-tax which the wealthy believers are commanded to pay annually on all of their surplus wealth which has been in their possession for a period of one calendar year. 

If you save Rs. 200,000.00 per year, and you have this amount saved and in your possession for a period of one calendar year, zakah would be liable on this saved amount.


Property In wife’s name:

Q-1A:  Land plot valued at current price Pak Rs.3 million

If the land has been in your possession for a period of one calendar year, a 2.5% zakah would be liable on its fair market value.


Q-2A:  Land plot valued at current price Pak Rs.2 million

If the land has been in your possession for a period of one calendar year, a 2.5% zakah would be liable on its fair market value.


Q-3A: Car valued at Pak Rs.350,000. (In wife’s use)

Not liable for zakah if the car is being used by your wife.


Q-4A:  Gold Jewellery belonging to and in personal use of wife, worth Pak Rs.250,000.
The jewelry would be liable for zakah at 2.5% of its value, provided it has been in your possession for a period of one calendar year.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.
