I have a doubt on removing zakat money over jewels

One of our brothers/sisters has asked this question:

dear brother


as-salamualaikum.

i have a doubt on removing zakat money over jewels.is it compulsary that our posession of jewels must remain with oneself for one full year to remove zakat on it.


suppose i have 100 soverigns of gold and i have removed zakat on it should i remove zakat on them every year.


if i sell all the jewels in 10 months and spend the money which i received from selling the jewels, then what happens to zakat?


if so please give me some proofs from quran or hadith.

Zakah on Jewel

In the name of Allah, We praise Him, seek His help and ask for His forgiveness. Whoever Allah guides none can misguide, and whoever He allows to fall astray, none can guide them aright. We bear witness that there is no one (no idol, no person,  no grave, no prophet,  no imam,  no dai,  nobody!) worthy of worship but Allah Alone, and we bear witness that Muhammad (saws) is His slave-servant and the seal of His Messengers.

Who is Obliged to Pay Zakah

Zakah must be paid by every Muslim who has a nisab (wealth in excess of approximately US$1,000.00) , which is the minimum of one's holdings liable to zakah. The nisab is conditioned by the following:

1.       Zakah should be paid on any amount of money remaining after meeting the expenses for such necessities as food, clothes, housing, vehicles and craft machines.

2.       A complete year of Islamic calendar should pass, starting from the very day of the nisab's possession, without any decrease during the year. In case of its decrease (being less than nisab), the year count (hawl;) starts from the day of the nisab completion.

Commenting on the issue, Imam an-Nawawi said: "In our view and the views of Malik, Ahmad, and the majority of scholars, the amount of property liable for payment of zakah, such as gold, silver, or cattle, is tied to the completion of nisab through the turn of a whole year. If the nisab decreases in any time of the year, [the counting of] the year discontinues. Later, if the nisab is completed, the year count is resumed from the time of its completion."

Abdullah told of two women, wearing gold bangles on their wrists, coming to Allah's Messenger (saws), who asked them whether they paid zakat on them. On their replying that they did not, he (saws) asked them whether they wanted Allah to put two bangles of Fire on them, and when they replied that they did not, he (saws) told them to pay the zakat due on them.

 

The obligatory zakah is due on every excess wealth which has been in one’s possession for a period of one calendar year at the rate of 2.5% of its value.  The jewels or jewelry one owns is definitely part of one’s excess wealth, and zakah would be due on the value of any jewels or jewelry which has been in your possession for a period of one calendar year.

 

Your Question: suppose i have 100 soverigns of gold and i have removed zakat on it should i remove zakat on them every year.

The zakah is an annual obligation one pays towards the poor and needy believers for the Sake of Allah Subhanah, and it is a form prescribed by the Lord to purify the wealth that remains with the person.  It is absolutely obligatory that one pays zakah on the value of one’s excess wealth every year on an annual basis.

 

Your Question: if i sell all the jewels in 10 months and spend the money which i received from selling the jewels, then what happens to zakat?

If you spend the wealth that you received from your sale of jewelry and buy other excess wealth like investments, properties, stocks, etc.; then zakah would be liable on the value of that excess wealth at the rate of 2.5%. 

 

But if for instance the wealth that you received from the sale of your jewels after ten months was not spent on further investments, but rather upon yourself or your family, or was given as a gift to someone, or was spent in building a mosque or other charity….then there is no zakah due on the sale amount of the jewels itself for the particular calendar year because the wealth was spent and does not belong to you any more.  Zakah is only liable and due for the value of the excess wealth of a believer which has been in his possession for a full calendar year.

 

Whatever written of Truth and benefit is only due to Allah’s Assistance and Guidance, and whatever of error is of me alone.  Allah Alone Knows Best and He is the Only Source of Strength.
